Mississippi DUI Defense Lawyer
Blood and Breath Tests
When arrested for DUI in Mississippi, you are required to provide a blood or breath test analyzing the level of alcohol in your blood system to determine if you were driving over the legal limit of .08%. As Mississippi has an "implied consent" law, you are required to provide these tests by law, and cannot refuse taking them without running the risk of losing your driving privileges.
The breath test is usually done with a breathalyzer device which measures your blood alcohol level. There are different types of devices that are used to measure your blood alcohol content, but the common one being used in Mississippi is the Intoxilyzer 8000. As with any device, it can give inaccurate readings if it has not been properly maintained, if the operator of the device is not properly trained in using it, or if it is used incorrectly. At Miller & Miller, our Mississippi DUI defense attorneys are trained in the operation of this device and know all of the details on exactly how it is supposed to work and be administered. With this vital training, we can more effectively review evidence against you for any discrepancy in the correct procedure being used when you were given this test.
A blood test for alcohol is not as common, but can still be used by law enforcement. A kit is used to take the blood sample, which is then tested for level of alcohol in the blood. As with the breath test, if the operator taking the blood sample fails to properly follow protocol, or the sample is contaminated in any way, we have the opportunity to dispute that evidence, which could win your DUI case.
