Mississippi DUI Lawyer
What happens when you refuse a breathalyzer test in Mississippi?
Mississippi is an "implied consent" state, meaning that when you apply for your driver's license, part of the application process includes wording that you agree to a breath, blood or urine test in order to determine your blood alcohol content if you are suspected of drunk driving. You therefore can be subject to automatic license suspension if you refuse to take a breathalyzer test when asked to do so by a police officer. You have ten days following an arrest or refusal to file a test refusal petition in order to attempt to stop the automatic suspension. This petition does not postpone the suspension, but will allow you to fight to get the suspension reversed if the petition is granted. If you find yourself in these circumstances due to having refused a breathalyzer test, you need the expertise of Mississippi DUI attorneys from Miller & Miller Attorneys at Law, PLLC to assist you with the filing of the petition and the hearing you will need to attend.
Anyone refusing a breath test will receive a letter of intent to suspend your license. While this administrative procedure is occurring, you have 45 days from the date of your arrest prior to your license being suspended, with no allowance for renewals or extensions. Avoiding this suspension by applying for the hearing can help you attempt to keep your license from being suspended. At the administrative hearing, which is informal and not in front of a jury, you will be advised whether you will be able to retain your license until your DUI criminal case is held, or whether your license will be suspended right away. At this hearing, our attorneys can present an effective petition and cross examine the officer who arrested you, as well as any other witnesses. By taking an aggressive stance during this hearing, your DUI defense lawyer may be able to help you keep your license.
