Field Sobriety Tests

When someone is suspected of driving under the influence and is pulled over by law enforcement personnel in Mississippi, the officer may choose to administer field sobriety tests to determine intoxication. A driver can be asked to perform simple tests set up by National Highway Traffic and Safety Administration guidelines called standardized field sobriety tests. The common and approved tests used in the field are:

  • The one-leg stand
  • Walk and turn
  • Horizontal gaze nystagmus test

Other tests that may be used by law enforcement which are considered non-standardized might include:

  • Stand with feet together and tip the head backwards
  • Count the number of fingers that the officer raises
  • Recite the alphabet or a portion of it
  • Count backwards
  • Rhomberg stationary balance test
  • Finger to nose test
  • Hand pat test

While the field sobriety test is used to determine whether to take someone into the station for further testing, it is the breath, blood or urine test that is normally done at the station. If you have been arrested for DUI due to a failed field sobriety test, contact Miller & Miller Attorneys at Law, PLLC, Mississippi DUI lawyers. We can assist you in fighting your DUI charges through careful evaluation of how your field sobriety tests were conducted and whether a failure to follow strict protocol during the procedure can be challenged in court.
